Can Development And Environment Go Hand In Hand?

If the government’s intentions were right, why cut the trees at night instead of waiting for daylight? This was the common question asked by the hundreds who rushed to Aarey Colony late on Friday night to protest the cutting of trees.

The night tree felling operation seems to have united the city’s various citizen-activists.

The first few landed to confirm if the news about cuttings was true. As a video-recording by them went viral among the green lobby, many more rushed to “protect” the remaining trees. Activist Amrita Bhattacharjee said, “The area was full of people, most of whom were common citizens who came on their own accord to register their concern.”

The activists pointed out that under Section 8(3) of the Trees Act, 1975, no tree can be felled until 15 days after the Tree Authority grants permission (Bombay high court’s October 11, 2018, order directed the Tree Authority to put up its permission on the BMC website). The Tree Authority issued permission to MMRC to fell over 2,000 trees on September 13. However, the activists noted the permission was uploaded on the civic website only on October 4. They contended that no tree can be cut until 15 days and hence rushed to high court on Saturday seeking a stay as the Supreme Court is shut till October 13 for Dassera.

But MMRC’s managing director Ashwini Bhide contended on Twitter the 15-day period ended on September 28. “The Tree Authority order was issued on September 13. 15 days are over on September 28. Action awaited till Hon HC verdict was out,” she tweeted on Saturday.

At Aarey, activists spent the day either walking in groups of twos and threes due to promulgation of CrPC Section 144.

Many had been around for over 12 hours. Chembur’s Sanjiv Valsan saw policemen taking some protesters and dragged him too. He said, “It’s typical behaviour of a guilty party to do such things (tree cutting) in dark of the night to avoid attention. There were bouncer-type of people in plainclothes manhandling the protesters.” He alleged narrowly missing a head injury. One Sayyad Tabrez said, “While coming out of the barricaded areas, my friends and I were assaulted.”
